TradeTestimonials is a service that helps tradespeople collect, publish, and manage customer testimonials. A tradesperson ("you") submits a customer's contact details so we can send that customer a short feedback request by SMS or email; the customer's response is turned into a testimonial you can review, edit, and publish on your own public testimonials page.
You are responsible for having your customer's permission, or another lawful basis, before submitting their contact details to us for a feedback request — this is why the request form requires you to confirm this each time. You are responsible for the accuracy of the information you submit and for how you use any testimonial we help you publish.
When you use TradeTestimonials to request and publish customer testimonials, you are the data controller for your customers' personal data and TradeTestimonials ("we", "us") acts as your data processor. This section sets out the terms of that processing relationship, in line with Article 28 of the UK GDPR.
Processing takes place for as long as you maintain an account with us, or until data is deleted under the retention terms in 3.8, and consists of collecting, storing, transmitting, and displaying the personal data described below in order to operate the testimonial-request and publishing service described in these Terms.
The personal data processed relates to the customers you submit testimonial requests for ("data subjects"), and comprises: name; phone number and/or email address; a short description of the job carried out; and the customer's ratings, free-text comments, and any before/after photos they submit in response to a request. Full detail is in our Privacy Policy.
We process this data solely to: (a) send the testimonial-request message on your behalf; (b) present the feedback form to the customer; (c) use an AI model to help turn their raw feedback into a draft testimonial for your review; and (d) publish the testimonial you approve on your public testimonials page. We do not use customer data for any other purpose, including our own marketing.
We only process personal data submitted through the platform in line with these Terms and your use of the service's features (creating a request, approving a testimonial, editing or deleting a testimonial, and so on). We will not process it for any other purpose unless required by law, in which case we will tell you first unless the law prohibits this.
Anyone we authorize to access personal data, including the sub-processors listed in 3.10, is under an obligation of confidentiality, whether contractual or statutory.
We apply technical and organizational measures appropriate to the risk, including encrypted data in transit, and access to the underlying database and file storage restricted to what the running application needs. No system is completely secure; see 3.9 for what happens if that ever fails.
If a customer contacts us directly about their data, we will forward their request to you (as the controller) unless they've asked us to act on it directly, in which case we will and will tell you. Your dashboard gives you direct edit and delete control over testimonials and requests, on top of the automatic retention period in 3.8.
Customer phone numbers and email addresses are automatically deleted 14 days after their testimonial request is closed (published or declined) — see our Privacy Policy for detail. Deleting your account (see section 6) deletes all remaining personal data associated with it, including published testimonials.
If we become aware of a personal data breach affecting your customers' personal data, we will notify you without undue delay, with enough information to let you meet your own obligations to the ICO and any affected individuals.
We use the following sub-processors, each processing only what their specific function needs: Twilio (sending SMS messages), SendGrid (sending emails), Stripe (processing your subscription payments), and Anthropic (drafting testimonial text from customer feedback — the request sent to Anthropic includes the job description, ratings, and any free-text comments, never the customer's name, phone number, or email address). We may change sub-processors from time to time; material changes will be reflected in an update to this page.
On reasonable written request, we will provide the information reasonably necessary to demonstrate compliance with this section, and will allow for and contribute to audits, including inspections, conducted by you or an auditor you mandate, subject to reasonable notice and confidentiality.
Free accounts may publish a limited number of testimonials and send a limited number of requests. Once the free published-testimonial limit is reached, a paid subscription is required to publish further testimonials and to continue using the dashboard; your existing published testimonials and public testimonials page remain live regardless. Paid subscriptions are billed monthly via Stripe. You can manage or cancel your subscription at any time from your dashboard's billing section.
Don't use TradeTestimonials to contact anyone without a lawful basis to do so, to submit fabricated or misleading testimonials, or to send unsolicited marketing through the platform.
Cancelling your subscription is not the same as deleting your account. Cancelling (from your dashboard's billing section) stops payment and locks you out of the dashboard, but any testimonials you've already published stay live on your public page. Deleting your account is separate, permanent, and available from your dashboard at any time: it immediately and irreversibly deletes your account, every testimonial request and testimonial (published or not), every uploaded photo, and cancels any active subscription. We may also suspend or terminate accounts that violate these terms.
The service is provided as-is. We aren't liable for indirect or consequential losses arising from your use of the service, to the extent permitted by law.
These terms are governed by the law of England and Wales.
